We have therefore implemented the principles of the Web Content Accessibility Guidelines (WCAG) as published by the Web Accessibility Initiative (WAI) of the World Wide Web Consortium (W3C), in addition to the requirements listed under the Twenty-First Century Communications and Video Accessibility Act of 2010. It is HUXWRX Safety Co. goal to make every page of its website accessible for all individuals. Due to the use of third-party vendors, however, HUXWRX Safety Co. cannot guarantee that all parts of all pages are fully compliant with WCAG’s Conformance Level A or Conformance Level AA. Further, HUXWRX Safety Co. makes no representation that the entirety of its website conforms the WCAG guidelines, but it has taken steps to ensure partial conformance as defined by WCAG 2.0, Conformance Level AA. Defendant shall, within twenty-four (24) months of the Effective Date, use good faith efforts to improve the accessibility of its website, including by using the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards. Should the Department of Justice issue final regulations adopting a legal standard for website accessibility that is different from the WCAG 2.1 Level AA standards, Defendant shall have the option of complying with that legal standard within the timeframe provided by the regulations instead of the WCAG 2.1 Level AA standards, which option it may exercise in its sole discretion. Notwithstanding the foregoing, Third-Party Content on Defendant’s website will not be required to meet the WCAG 2.1 Level AA standards. The term “Third-Party Content” refers to web content that is not controlled, developed, or owned by Defendant or any of its subsidiaries, parents, or affiliates.
